  • Update: NCAA, FSU to pay $325,000 to reimburse media outlets for lawsuit costs
    Fri, 30 Jul 2010 10:06:00 EST
Florida State University and the National Collegiate Athletic Association will pay $325,000 to reimburse the legal fees of media groups that sued them in an open-records case and won. The agreement was reached through mediation Thursday and was filed in circuit court Friday morning. FSU will pay $65,000 to the Tallahassee Democrat and Gannett Co. Inc's Florida newspapers and televisions stations, along with more than 20 other media outlets that filed suit in June 2009. The NCAA will pay $260,000. Florida courts last year ruled that documents in an athletic-cheating sanctions case were open records. Last week, Circuit Judge John Cooper ruled that the media groups could have their legal fees reimbursed, as allowed by Florida law in open-records litigation. In September, lawyers for the media group sought legal fees to that point of $324,112 from FSU and the NCAA. Barring the mediated agreement reached this week, Cooper would have decided how much was owed and by whom. Cooper's order last week that legal costs could be recovered stated the case against "By insisting on transmitting public records to FSU, a public institution, in a manner designed to maintain secrecy, the NCAA actively attempted to interfere with FSU's obligations under the Florida Constitution and Florida's Public Records Act," Cooper wrote in his 10-page opinion. "FSU was complicit in this arrangement." Bob Gabordi, executive editor of the Tallahassee Democrat, said the case showed media outlets are willing to fight for enforcement of Sunshine Laws. "Knowing that media outlets are fully engaged, watching closely and willing to take on those who violate the public's right to access government records in Florida is the only effective deterrent to such scofflaws," Gabordi said. FSU has already spent more than $100,000 on its own defense in the case. Florida State officials in March calculated the university spent $102,108 on outside attorney fees from June 2009 to January 2010.
